Ignite Music Terms and Conditions
1. Engaging with Ignite Music
a. By enrolling with Ignite Music, the Client commits to the ongoing terms of lessons provided. Ignite Music will automatically invoice Clients monthly unless appropriate notice is given (see Section 3, "Cancellations of Lessons").
b. Lessons are billed monthly in advance, based on the number of weeks or lessons in a calendar month.
c. Clients agree to remain up-to-date with their payments. Invoices must be paid before lessons commence for the upcoming month.
d. Initial invoices will cover the period from the commencement of lessons until the end of the first billing cycle.
e. Monthly invoices will be issued on or around the same date each month and are due within 7 days of issue.
f. Late payments may result in the suspension of lessons until the account is brought up to date.
g. If a payment is overdue by more than 20 days past the due date, a late fee may apply. The late fee amount will be determined based on the overdue balance and communicated to the Client.
h. Outstanding debts that are difficult to recover will be referred to a debt collection agency. The Client agrees to be liable for any additional costs incurred during the debt recovery process.
i. Ignite Music reserves the right to cease services if payments are not made in accordance with these terms.
2. Make-Up Credits and Lessons
a. Clients may receive up to two make-up credits per school term for lessons they are unable to attend, provided notice is given by email or text no later than 9:00 AM on weekdays and 8:00 AM on weekends.
b. Make-up credits issued for cancellations caused by Ignite Music, such as teacher absences, are unlimited and valid for 365 days from the date they are issued.
c. Make-up credits can be used for scheduling replacement lessons but cannot be redeemed for monetary value, refunded, or deducted from future invoices.
d. Missed lessons without sufficient notice will be forfeited and will not qualify for a make-up credit.
e. Make-up credits are not provided for group lessons missed due to the Client’s fault. Missed group lessons will be forfeited unless the cancellation is initiated by Ignite Music, in which case a credit will be applied to the Client’s account.
f. Ignite Music will endeavour to secure the same teacher for make-up lessons but cannot guarantee availability.
g. Make-up credits are limited to two per school term unless the cancellation is due to reasons on Ignite Music’s part.
3. Cancellations of Lessons / Disengaging with Ignite Music
a. Clients must provide at least one month’s written notice (via email) before their next billing date if they wish to cancel their enrolment.
b. No refunds will be provided for unused lessons or prepaid amounts after the billing cycle begins.
c. In the event of dissatisfaction with services, Clients should arrange a meeting with Ignite Music management to resolve the issue. If service cannot be adequately provided, a credit may be issued.
4. Attendance and Commitment
a. Clients are expected to maintain consistent attendance. Irregular attendance without proper communication may impact a student’s progression and the availability of their preferred lesson time.
b. Ignite Music reserves the right to reallocate lesson slots if attendance falls below 60% for any given term.
c. If a Client requires a permanent schedule change, this must be requested via email. Ignite Music will do its best to accommodate but cannot guarantee availability.
5. Communication and Feedback
a. Ignite Music encourages open communication. Clients can email or call the admin team with questions, feedback, or concerns.
b. Feedback forms may be provided periodically to help Ignite Music improve its services.
6. Health and Safety
a. Students showing signs of illness should not attend lessons in person. Virtual lessons may be arranged if notice is given at least 24 hours in advance.
b. Ignite Music complies with all NSW health and safety guidelines. Clients agree to follow any policies related to hygiene, safety, or conduct while on the premises.
c. Clients are responsible for ensuring children are supervised until lessons begin and picked up promptly afterward. Ignite Music does not provide childcare services.
7. Lesson Delivery and Quality
a. Ignite Music reserves the right to adjust lesson formats (e.g., group, individual, or online lessons) as needed to accommodate availability, scheduling, or emergencies.
b. Teachers are carefully selected and trained to provide high-quality instruction. If a teacher change is necessary, Ignite Music will notify the Client and ensure a smooth transition.
c. Ignite Music may offer online lessons in cases of unavoidable disruption (e.g., inclement weather, public health concerns).
8. Fee Adjustments and Discounts
a. Ignite Music reserves the right to review and adjust fees annually. Clients will be notified of any changes at least 30 days in advance.
b. Family discounts may be offered for multiple students from the same household enrolled in lessons. The terms of such discounts will be clearly communicated.
c. Missed promotional discounts (e.g., for early payment) cannot be retroactively applied.
9. Digital Platforms and Privacy
a. Ignite Music will transition to Opus 1 scheduling software. Clients agree to provide accurate and up-to-date contact information for communication through this platform.
b. All personal information provided will be stored securely and used solely for business purposes in compliance with Australian privacy laws.
c. Video and photo content may be recorded during lessons or events. Ignite Music retains the right to use this content for training, promotional materials, and social media unless the Client opts out in writing.
10. Teacher Absences and Studio Closures
a. Ignite Music will provide advance notice of any teacher absences or studio closures and arrange make-up lessons or credits where applicable.
b. In cases of unforeseen closures (e.g., emergencies or power outages), Ignite Music will notify Clients as soon as possible and work to reschedule missed lessons.
11. Behaviour and Conduct
a. Ignite Music maintains a safe and respectful environment. Any form of disruptive or inappropriate behaviour from students, parents, or carers may result in suspension or termination of services.
b. Clients agree to treat staff and other students with respect. Harassment or bullying will not be tolerated.
12. Refunds and Credits
a. Refunds are not provided for unused lessons, missed lessons, or prepaid amounts, except in cases where Ignite Music cannot fulfill its service obligations.
b. Credits for lessons or missed sessions will be applied to the Client’s account for future use, as outlined in the Make-Up Credits policy.
13. Legal Protection and Compliance
a. All payments and interactions are governed by the laws of New South Wales, Australia.
b. Clients agree to indemnify Ignite Music against any claims, damages, or liabilities arising from their use of our services, except in cases of negligence by Ignite Music.
c. Ignite Music will not be held liable for any injuries or incidents occurring on the premises unless directly caused by negligence.
d. By engaging with Ignite Music, Clients confirm that they have read, understood, and agree to abide by these Terms and Conditions.
